23-24 apprenticeship breaks in learning

I had thought I understood the new rules around 23-24 Apprenticeship breaks in learning, but reading through them again, I'm not sure I do.

Would a break be needed for the following scenarios, and why? I'm more confident about the answers to 1 and 3, but scenario 2 is tripping me up.

In all scenarios there was a plan for there to be training in each month.

1. Learning takes place on 05/08/2023. More learning is planned to take place in August, but is missed.

The next learning occurs on 14/09/2023.

2. Learning takes place on 05/08/2023. More learning is planned to take place in August, but is missed.

No learning in September.

The next learning occurs on 29/10/2023.

3. Learning takes place on 05/08/2023. More learning is planned to take place in August, but is missed.

No learning in September or October.

The next learning occurs on 08/11/2023.

Yes (whole calendar month with no learning)

If the second one was missed in September *but replanned* as a catch up in October, then no BIL required.

1 and 3 as I expected, but good to have that confirmed.

Regarding scenario 2 I'm still not clear about this. 

There's this paragraph:

75.5. If planned off-the-job training is unable to take place as scheduled in any calendar month, a retrospective break in learning is not required as long as there is active learning in the following calendar month.  The provider must ensure that all missed activity is re-planned and delivered, so that the full content of the training plan can still be delivered.

I'm assuming as everyone else seems to be that "in any calendar month" means, "for a full calendar month". I hope that's correct?

So, if OTJ is unable to take place as scheduled in September (which is the only missed full calendar month in this scenario), then surely a break is not required as there is active learning in the following calendar month?

The re-planning bit seems to not be a caveat but an instruction that we must re-plan? (and of course we must).

Is there something I've missed somewhere that contradicts this?

Sorry Becky, yes, I agree with your reading of the Rules. I'd argue no learning from 5/8 to 29/10 is *super* pushing it, but does match what P75.5 says

Thank you, Steve. You can see why I'm second guessing myself though! 

I have managed to read these rules both ways as you have. I wish they would just give a clear set of examples, but I know that's a pipe dream.

I've also asked the helpdesk, so I'll see what they say.

As ever, it's important to know what other non-ESFA people think so we can collectively identify where the ESFA think they are being clear, but are not, rather than it just being certain individuals not understanding (like the wishy-washy wording the first time they introduced the 28 day "rule", where we all interpreted it differently to their intention).
