There's a new rule which I think allows them to complete EPA.
109. Where an apprentice has changed employer after they have completed all the training and reached gateway, including where the new job role is not related to the apprenticeship, they may complete the end-point assessment in agreement with the end-point assessment organisation and the provider that it can be satisfactorily taken and paid for. We will issue further technical details as to how this change should be reported to us including how the provider can claim the completion payment.
It does say "changed employer", but I don't see how that is different from "left employer" when the new employer would have absolutely nothing to do with the EPA, so it doesn't matter whether they exist or not. I can't find that they've issued the technical details yet, but I've told our teams that they can do this, and I'll worry about the ILR coding later. We'll make sure we close the employment history record, and get the previous employer to stop the DAS.

Resits will have to be something each provider decides how to manage, ESFA aren't going to pay for that. You might just decide to say no to resits in this circumstance.

EPA started before dismissal from employment

Some advice please,
I have a learner that started the EPA process but then was given notice by the employer. Im struggling to find this situation in the funding rules. If they hadn't completed learning (and wasn't reemployed) then I know I have to report this as a withdrawal but that isn't the case.
Initially the employer agreed to fund the EPA but has since disputed this.
