Apprentice wage for starting a second apprenticeship

We have an apprentice potentially moving on to a L3 apprenticeship having completed her Level 2. She is 24. The employer is asking if they can move her back to the minimum/first year wage as it is a new programme?

The rules and legislation indicate that the employer can do so, but who would work for such an Employer?

The only point I would make is that progression through apprenticeship levels is not applicable as an Apprenticeship is against a specific occupation.
