The guidance states that this must be completed for learners who are with an employer with ACT 2 code. As this code no longer exists and all learners go through the apprenticeship service, do we still have to collect this information?

Short answer is "no" if you only do ACT1 Apprentices (if you've got any AEB, I'd leave it on, but not if you're just an App provider).
What the funding rules say is: If you deliver training to employers who do not pay the levy you may be accessing funding that can be used as match funding for the European Social Fund (ESF).
Yes this would include ACT 2 but could also include those recorded as ACT 1.
