Employment during the EPA period re: re-sits failed

Happy new year, hope everybody is well.

I have a query with regards to employment during the End Point Assessment Period.  It currently states in the Apprenticeship Funding Rules for Main Providers 21-22 V2 (page 42, paragraph 158) “the apprentice must be employed until the end-point assessment is completed.  The only exception is where the apprentice has been made redundant and we are funding the apprenticeship to completion.  Consideration must be given to the potential time needed for any re-sit and / or re-training prior to re-taking the end point assessment so the apprentice remains employed during this time."

It also states on page 93, paragraph 378.3 that the evidence pack must include “a signed statement by employer and provider that the apprentice is still employed until the end-point assessment is completed”.  Is anybody able to clarify if this means that the Apprentice needs to remain employed until they pass their End Point Assessment or just remain employed until they have completed it regardless of the result (for example if they have failed a first attempt and failed a re-sit, is the Employer required to keep the Apprentice as an employee).

I did contact Apprenticeship Service Support in mid December with regards to this matter but still no further along, our query is still sitting with their "technical support team".

Any advice would be very much appreciated.

A EPA completion is when they go through gateway and pass all elements of the EPA. They would need to be employed until they have met this requirement.

The only guidance is what Kelly has said, I expect this would include any resit required for them to complete although you may claim the competition payment if they initially fail.

Recording apprenticeship standard completions

For apprenticeship standards that complete their learning on or after 1 August 2019, when all of the training and end point assessment elements have been completed, the following should be recorded:

  • All the component learning aims within the programme must be closed with the Learning actual end date set to the date of the last learning activity for the aim(s).
  • The programme aim must be closed with the Learning actual end date recorded as the date the training period for the programme was finished, not including the end point assessment period.
  • The programme aim must be updated with the Achievement date recorded as the date the end point assessment period for the programme was completed, whether the outcome was a success or a failure.
  • The Date applies to must be recorded on the latest Apprenticeship contract type FAM record as the same date as the achievement date for the programme aim.

When the end point assessment period for the apprenticeship standard is complete, the Outcome field must be updated accordingly.  If the apprenticeship standard has resulted in a failure at the end point assessment, the Outcome on the programme aim must be recorded as code 3 ‘No achievement’.  If the apprenticeship standard is successfully achieved following the end point assessment, the Outcome on the programme aim must be recorded as code 1 ‘Achieved’.

In order to be recorded as ‘Completed’ (Completion status code 2), both the training and end point assessment activities for the programme must be completed.  An end point assessment that has resulted in a failed outcome can be classed as complete as long as the learner reaches the end of the end point assessment period, rather than withdrawing.  If either of these have not been completed, then the programme aim cannot be recorded with Completion status code 2.

Are you able to point me in the right direction of the guidance you have found so I have it for future reference.

It depends.. if they don't plan on re-sitting again then the programme has been completed, regardless of it resulting in a failure, and it now doesn't matter if they're no longer employed as the programme is finished. As you rightly quoted, the 'end point assessment activities for the programme' have now been concluded so you record the learner on the ILR as;

Completion status: 2 - Completed the learning activities

Learning actual end date: Date of last learning activity towards the practical period

Outcome: 3 - no achievement

Achievement date: Date of the latest/last EPA as this is the last EPA 'activity'

ACT Applies To: Same as Achievement date
