I have had a response from the EPAO as follows: If the apprentice will be seeking work within this sector the 30 day rule applies. E290.1 When employment or an apprenticeship agreement has ended (resignation, dismissal or any other action by the apprentice or the employer that results in the apprenticeship agreement ending, with the exception of redundancy) and new employment has commenced within 30 days we do not expect a withdrawal to be recorded The apprentice in question wants to complete her EPA and also wants to go on to do a L3 apprenticeship, so is actively seeking work in the sector. So under these circumstances, if she is looking for work and we are helping her to find a new employer, and she completes her EPA in the meantime, then that is within the rules. Obviously we would keep evidence of this. Obviously there are different ways of interpreting the rules!

Thank you. That is how I understood it. I have asked the EAPO where they got their information from and I suspect you are correct and they are getting mixed up with the 30 day gap between employers.

OK so it looks as though there is no way round it. My final question is, once she has completed her PGCE can she restart her apprenticeship and take her EPA if she still wants to do this, or is there a time limit.

Hi Martin I understand the employment side of things I was looking for confirmation as to whether she was allowed to start the PGCE if it was funded through a loan at the same time as waiting for EPA. If not then there is no point in trying to resolve the employment issue. She is desperate to complete her EPA and would be willing to find alternative employment to do so. I don't think she realised when she left that this would affect her EPA.

This seems rather harsh on the apprentice who has met all the other requirements of the apprenticeship. The PGCE is funded through a Student Loan so would this make any difference to her situation?.

If we use EEF code 4 will that not claim another £1,000 for the apprentice as well? Or will the system know the apprentice has already received the £1,000 and only pay the employer and provider.

Hi Martin We are not wanting to claim the care leaver bursary, just the additional payments for the provider and the employer.
