Hi Again I've just had this response from the Service Desk and wanted to gauge peoples thoughts !! (below in bold) It was a genuine admin error, as we failed to tick the SEM field for this 16-18 apprentice,however I'm sure the employer won't pay us the contribution as they are a SMALL EMPLOYER and this will now cost us a completion payment plus we have already had to pay the EPAO. Dear Chris Baker, You previously raised an incident with our Specialist Support team. The Specialist Support team have been in touch today with the following response: We would not allow the use of the LDM code in this case. The SEM code to waive co-investment must be added to the ILR at the start of the apprenticeship - not in a later academic year. This is as per the apprenticeship technical funding guide - We determine whether we waive co-investment from the size of the employer at the start of the apprentice's programme; this determines whether we waive co-investment for the rest of the apprenticeship with that employer The lack of payment of co-investment will result in the provider not receiving the completion payment.

With regards to this topic,I've just received this reply from the A/S As the error was not rectified prior the R14 deadline - this co-investment will remain as due on your Co-investment contributions report. This cannot now be adjusted and the co-investment due will need to be recorded in your ILR. Can I clarify that if I apply to use LDM code 361,will this mean that it waives the expected employer contribution for the previous contract year ? Thanks Chris
