Hi Both, FYI the 'reduced' ILR privacy notice has not been updated yet. It still points to the old ESFA Privacy notice which no longer exists on the GOV.uk website. I assume that this will be updated to point to the new DfE one published 20th June. Phil

Hi Karen Travers I am in agreement that the stamp alone alone does not confirm acceptance to one of the Ukrainian schemes and BRPs are taking a while to come through. We have found that all our potential Ukrainian learners ( and/or their hosts) will have either an official email or letter from the home office with a case reference confirming their acceptance into the scheme and inviting them to travel to the UK. In the absence of a BRP we accept this letter/email in conjunction with a valid passport as proof or eligibility. HTH

Wendy Kay It refers to the start of the course. Be aware though that the six months would start from their date of application or their arrival in the uk which ever is later, and if they have a claim refused and they appeal the six months starts again from the date of appeal. 48.1. have lived in the UK for 6 months or longer while their claim is being considered by the Home Office, and no decision on their claim has been made I assume that there may be cases where date of application could pre-date arrival in the uk but for funding purposes the date of entry in the UK is the important one. Do you mean a Biometric Residence Permit (BRP) - if the learner holds one of these they are not an asylum seeker and and would need to meet the funding requirements dependent on their nationality/citizenship. Asylum seekers will/should hold an ARC (Application Registration Card). These look very similar to a BRP. HTH Phil

Crystal Hon - yes unfortunately all to often. Add a note to the commitment statement but do not change the original Planned end date on the ILR or the commitment statement and make the Employer aware that they should NOT update the Apprenticeship service. HTH Phil

If they meet the criteria of 'who we fund' in the funding rules - Specifically check the residency eligibility - then Yes. Whether they are eligible for full funding would depend on what you were enrolling them on. Full funding is available for: English and maths, up to and including level 2, for individuals aged 19 and over, who have not previously attained a GCSE grade 4 (C), or higher, and/or first full qualification at level 2 for individuals aged 19 to 23, and/or first full qualification at level 3 for individuals aged 19 to 23 essential digital skills qualifications, up to and including level 1, for individuals aged 19 and over, who have digital skills assessed at below level 1 They would not qualify for full funding under local flexibility as from your definition they do not meet the criteria for unemployed as described by the esfa: For funding purposes, we define a learner as unemployed if one or more of the following apply, they: receive Jobseeker’s Allowance (JSA), including those receiving National Insurance credits only receive Employment and Support Allowance (ESA) receive Universal Credit (UC), and their take-home pay as recorded on their UC statement (disregarding UC payments and other benefits) is less than £345 a month (learner is sole adult in their benefit claim) or £552 a month (learner has a joint benefit claim with their partner) are released on temporary licence, studying outside a prison environment, and not funded by the Ministry of Justice nor do they meet the criteria for discretionary full funding as they are not in reciept of another state benefit. David Dalby It's difficult to say exactly without seeing your file but the error you have posted implies that you have an empty OutStartDate element. In your ILR file Try searching for: <OutStartDate></OutStartDate> It should look like this: <OutStartDate>2022-04-12</OutStartDate> HTH Phil
